Introduction
These Terms of Use and Service Agreement (the “Terms”) constitute a legally binding agreement between the User and ELNIQ, S.L., a limited liability company incorporated under the laws of Spain (hereinafter referred to as “ELNIQ”).
ELNIQ provides digital services, software products, online platforms, analytical tools, artificial intelligence services, APIs, integrations, plugins, websites, and related technologies (collectively, the “Services”).
By registering for, accessing, or using any ELNIQ Services, the User fully accepts these Terms.
Users are encouraged to read these Terms carefully before accepting them.
If the User does not agree with these Terms, the User must refrain from using the Services.
These Terms should be read together with:

Updated pricing shall apply from the next billing cycle following such notice.
5. Cancellation
The User may cancel their subscription at any time through their account.
Cancellation shall become effective at the end of the period already paid for.
6. Right of Withdrawal (EU Consumers)
If the User acts as a consumer and resides in the European Union, the User has the right to withdraw from the contract within fourteen (14) calendar days from the date of purchase.
However, in accordance with applicable law, this right shall not apply where:

The User receives a limited, non-exclusive, non-transferable license to access and use the Services in accordance with these Terms.
Users may use reports, analyses, and outputs generated by the Services for their own internal business purposes unless otherwise specified.

- checking an acceptance box;
- purchasing Services;
- continued use of the Services.
2. User Requirements and Account
The User declares that:
- they are at least 18 years old;
- they have legal capacity to enter into this agreement.
The User is responsible for:
- maintaining the confidentiality of their credentials;
- all actions carried out through their account.
The following actions are prohibited:
- creating multiple accounts to circumvent limitations;
- sharing or transferring accounts without authorization.
3. Description of Services
ELNIQ provides digital services, software products, online platforms, analytical tools, artificial intelligence services, APIs, integrations, plugins, and related technologies (collectively, the “Services”).
Depending on the specific Service used, functionality may include:
- visibility analysis in artificial intelligence environments;
- website monitoring and analytics;
- bot access and crawler intelligence;
- AI-powered insights and recommendations;
- reporting and business intelligence;
- APIs, integrations, plugins, and automation tools;
- other digital products and services offered by ELNIQ.
The Services are provided exclusively online.
ELNIQ reserves the right to:
- modify, update, replace, suspend, or discontinue features;
- introduce new products, services, or functionality;
- improve existing Services.
In the event of substantial changes affecting essential paid functionality during a prepaid period, the User may be entitled to remedies provided under the Refund Policy.

Unless otherwise stated:
- prices do not include VAT or other applicable taxes;
- applicable taxes will be added at the time of billing in accordance with applicable law;
- the User is responsible for any applicable taxes.
In the event of payment failure:
- ELNIQ may suspend access to all or part of the Services;
- ELNIQ may attempt to collect payment again automatically.

However, in accordance with applicable law, this right shall not apply where:
- access to the Services has already begun;
- the User has expressly consented to immediate access;
- the User acknowledges the loss of the right of withdrawal in accordance with applicable consumer protection legislation.
Since access to certain ELNIQ Services may be activated immediately after payment, the User:
- expressly requests immediate access to the Services;
- accepts the loss of the right of withdrawal where permitted by law.
7. Refund Policy
Except where the right of withdrawal applies or where required by applicable law, refunds shall not be granted for periods already consumed or Services already activated.
However, refund requests may be evaluated in the following cases:
- evident billing errors;
- significant service interruptions;
- substantial reduction of essential functionality.
8. Use of the Services
The User undertakes to use the Services in accordance with applicable law.
8.1 Account Use
Access to the Services is personal and non-transferable unless the subscribed plan expressly permits multiple users.
8.2 Acceptable Use
The following are prohibited:
- unauthorized automated use;
- interference with the Services;
- unauthorized access to data;
- use that infringes the rights of third parties;
- attempts to circumvent technical restrictions or usage limits.
8.3 APIs and Integrations
Where APIs, plugins, scripts, or integrations are provided:
- use is subject to applicable limits and documentation;
- decompilation, reverse engineering, or attempts to access source code are prohibited except where permitted by law.
9. Suspension and Termination of Access
ELNIQ may suspend access to any Service in the event of:
- non-payment;
- breach of these Terms;
- misuse of the Services;
- security risks;
- unlawful activity.
10. Intellectual Property
All ELNIQ Services, software, technology, databases, analytical methodologies, reports, interfaces, trademarks, content, documentation, designs, source code, and intellectual property rights are owned by ELNIQ, S.L. or its licensors.
The User retains ownership of data submitted to the Services.
The User receives a limited, non-exclusive, non-transferable license to access and use the Services in accordance with these Terms.
Users may use reports, analyses, and outputs generated by the Services for their own internal business purposes unless otherwise specified.
The following are prohibited:
- copying the Services;
- reselling access to the Services without authorization;
- developing products that directly compete with ELNIQ through use of the Services;
- reverse engineering the Services except where permitted by law.
White-label use is permitted only when:
- included in the subscribed plan; or
- expressly authorized by ELNIQ in writing.
